Louise Arbour, United Nations High Commissioner for Human Rights
July 2004
Dear Louise Arbour, United Nations High Commissioner for Human Rights:
I would like to congratulate you on your new appointment as High Commissioner for Human Rights. The United Nations General Assembly
has approved a great new member. You succeeded Sergio Vieira de Mello, who was killed in a terrorist attack in Baghdad last August.
My condolences to the people of Rio de Janeiro for their loss. And I wish the best for this four years term.
The Office of the United Nations High Commissioner for Human Rights (OHCHR)
is to raise awareness of human rights and fundamental
freedoms and to publicize ways of promoting and protecting them at the international level. Another aim is to encourage debate
on human rights issues under discussion in United Nations bodies.
The mission of OHCHR is to protect and promote all human rights for all.
The United Nations vision is of a world in which the human rights of all are fully respected and enjoyed in conditions of global
peace. The High Commissioner works to keep that vision to the forefront through constant encouragement of the international
community and its member States to uphold universally agreed human rights standards.
It is your role to alert Governments and the world community to the daily reality that these standards are too often ignored or
unfulfilled, and to be a voice for the victims of human rights violations everywhere. It is also your role to press the international
community to take the steps that can prevent violations, including support for the right to development.
OHCHR is guided in its work by the Charter of the United Nations, the Universal Declaration of Human Rights and subsequent human rights
instruments, and the 1993 Vienna Declaration and Programme of Action. The promotion of universal ratification and implementation of human
rights treaties is at the forefront of OHCHR activities.
OHCHR aims to ensure the practical implementation of universally recognized human rights norms. It is committed to strengthening the
United Nations human rights programme and providing the United Nations treaty monitoring bodies and special mechanisms established by
the Commission on Human Rights with the highest quality support.
The High Commissioner for Human Rights is the official with principal responsibility for United Nations human rights activities.
OHCHR is committed to working with other parts of the United Nations to integrate human rights standards throughout the work of the
Organization.
Having siad all of that you know already, perhaps now you wonder what this letter is about.
First of all I would like to invite to participate in Global Dialogue 2004. I am sure the Global Community would gain a lot from your knowledge,
experience and sound judgement.
What issues could be of interests to you?
3. Criteria to obtain the Global Community Citizenship.
4. The statement of rights and responsibilities of a person and of belonging to 'a global community' and to 'The Global Community', the Earth Community, the human family.
5. Results of comparing the Universal Declaration of Human Rights and charters of nations around the world with the Scale of Human and Earth Rights.
16. Earth Court of Justice.
21. Humanity scale of social values.
28. Preventive actions against the worst polluters on the planet and those who destroy the global life-support systems.
35. Community rights on the Scale of Human and Earth Rights.
46. Justice is for everyone, anywhere and anytime.
54. Cities and global communities: power to govern themselves, rights and responsibilities.
The Global Community would really want your participation.
The Earth Court of Justice will hear cases involving crimes related to the global ministries.
It will have the power to rule on cases involving crimes related to each one of the ministries.
The Earth Court of Justice has listed America as the first nation to be prosecuted for a global environmental crime.
You could get acquainted with this problems by reading our press release and June Newsletter.
And certainly this Newsletter will take you right to the heart of the problem.
Because the leader of the USA was responsible for not signing the Kyoto Protocol, President George W. Bush will be first to appear in Court.
The reality here is that every American is on trial here. A large majority of the consumers in USA are also responsible for producing the deadly gas causing global warming and climate change, and they are all on trial. The same goes for every person
on Earth producing the deadly gas. The gas is just as deadly as the gas that murdered millions of Jews during World War II. It is even more deadly as it is destroying
the global life-support systems of all life on Earth. We are killing billions of human beings and countless life species. Americans have closed their conscience to the reality of life
on Earth. Justice must prevail to stop the "killing fields". And therefore they are guilty as charge.
The invasion of Iraq is another crime against humanity. Ever September 11 the Global Community has opposed the invasion.
Americans have invaded Iraq to steal their oil and gas. Read the President's message about this issue.
Oil and gas production will only last for another 30 to 50 years. They need the fossil fuels to feed the american economy, their war industry (about 50 million Americans live
off the industry directly or indirectly). Their vision of the world is a world ending with the end of fossil fuels. Whoever will have the biggest guns
at that time will survive. America is financially bankcrupted with a national debt of over 6 trillion dollars and will never pay it back because they know it does not matter. At least it wont matter
50 years down the road. The world will be under tremendous natural and human stresses only 30 years from now. Money wont mean anything. Guns will
mean survival. That is the vision of America. It is their vision on how they want to survive and what they will do to survive.
Democracy and human rights dont mean anything unless you belong with those who have the biggest guns.
The Global Community has a different vision of the world now and 50 years from now. Our vision is very much in tune with most nations of the world.
Prosecuting criminals on the basis of universal jurisdiction regardless of a territorial or nationality nexus required a solid
commitment of political will from national governments and the Global Community.
Once in effect, the Earth Court of Justice will become the principal judicial organ of the Earth Community. The International Court of Justice
was found powerless and inadequate to deal with crimes other those crimes dealing with genocides. On the other hand, the Earth Court of Justice will have a dual role: to settle in accordance with international law the legal disputes submitted to it by national governments, local communities, and in some special cases by corporations, non-government-organizations and citizens, and to give advisory opinions on legal questions referred to it by duly authorized organs and agencies.
The Court will be composed of judges elected by the Elected Representatives Council and
Earth Security Council. It may not include more than one judge of any nationality. The Members of the Court do not represent their governments but are independent magistrates. The judges must possess the qualifications required in their respective countries for appointment to the highest judicial offices, or by jurists of recognized competence in international law. The composition of the Court has also to reflect the main forms of civilization and the principal legal systems of the world.
The Earth Court of Justice will hear cases involving:
* nation states
* national political and military leaders accountable for violations of international humanitarian law
* 'core' crimes of genocide
* crimes against humanity and human rights
* war crimes
* crimes with significant impacts perpetuated against the life-support system of the planet (for instance wars and use of weapons of widespread destruction are listed under this category)
* crimes related to the relentless misuse of the Earth Resources
* environmental crimes
* social crimes as the Court may see apply
* crimes stemming from the global ministries
The Earth Court of Justice will also rule on global problems and concerns such as the creation of a new nation in the
world, and disputing territories or land between nations.
The procedure followed by the Court is defined in its Statute. The Court decides in accordance with:
* the Scale of Human and Earth Rights,
* belief, values, principles and aspirations of the New Age,
* international treaties and conventions in force,
* international custom,
* the general principles of law and,
* as subsidiary means, judicial decisions and the teachings of the most highly qualified publicists.
The Statute of the Earth Court of Justice will be established later.
The Earth Court of Justice established by the Charter of the Earth Community as the principal organ of the Earth Community
shall be constituted and shall function in accordance with the provisions of the Statute.
The Earth of Justice will handle environmental damage cause by the U.S. military action. The Earth Community has classified the damage as a criminal
liability for military personnel and/or their contractors. The war industry has become a liability to humanity.
Transnational organized crime has become so powerful that it can affect significantly the ability of governments to act. It is estimated that
about 5% of the global economy, that $1.6 trillion per year, is laundered through the international financing system. A solution to reducing
organized crime is to decriminalize drugs and put drugs under state control. Much more should be done to identify sources and target
money-laundering locations, create an international agreement to establish a registration system for major financial transactions, share
information on financial transactions, and coordinate prosecuting strategies. All banks would be required to cooperate or be frozen out
of the international system. The international body would be able to freeze criminal assets prior to conviction and the transfer of assets after conviction.
Perhaps you wonder what you could do to help human rights. You could help by participating in
Global Dialogue 2004. Help
us promote the Scale of Human and Earth Rights, and the criteria to obtain the
Global Community Citizenship.

The ECO Award, peace category
Hi there! I am very honoured that you feel I have made a difference in your life! You made a difference in my life too because you nudged me to formalize my
understanding of human and social development.
Since then, I have written pieces on the human condition and an entire keynote for a citizenship education conference on human and social development, etc
(2002) in Norway. I am doing a keynote in Tasmania in January on holistic sustainability and a four hour workshop on participatory/accountable consumerism. I
am going to give a keynote on home ec and sustainability in Ankara Turkey in 2006. And, I may be giving keynote on transdisciplinary practice at the European
global citizenship conference in Slovakia in May, 2005. I just did a keynote (invited talk) at St. Thomas More college on peace and consumerism from a post
modern perspective last week. I did a keynote on consumerism as structural violence at the Maharashi University of Management in Sept, 2004. Also, I am in
the 2005 Canadian Who’s Who. I am writing a book on transformative practice.
All of these and more are at my website. You opened the door for my thinking and I thank you! If you were serious about me getting the award, I guess I qualify
for the peace category or the human and social development category. I do not know who is on the committee but I am interested in the award.

Dear Germain
- Appreciate your reply and was pleased to note that we have similar interests in cosmology. There is every reason to be concerned about the
state of our planet. I believe we will get through this difficult period, largely because of people like you who are making a tremendous difference for the better.
The Global Dialogue concept and effort is unparalleled for providing and sharing positive insight with many in making the future brighter and attainable. About the
newsletter perhaps you might in some way refer your readership to the Forelaws webpage www.geocities.com/forelawsship/CosmicGenealogy.html. Internet
communication could not have come at a more propitious time for new dimensions in science, philosophy and religion, given impetus and direction again by your

Thank you Robert for your message.
I have visited your website. Very interesting! I have an affinity for your work as my Master Degree Thesis was on
Cosmology and Cosmogony. I have always thought humanity could spread life throughout the universe or at least part of it. Over the past few years I have seen
so much destruction on Earth and the depleting of Earth resources that I now have strong doubts we could do it. We will be out of fuels in a few decades and the
fuels we have been using are destroying life on Earth. It wont get any better. Just as much as I would like us to travel the galaxies it will take an act of God
allowing us to do so.
What are your thoughts?
Germain
Note: would you have an article for our Dec/January Newsletter to be published on the Global Community website?

Mr. Germain DuFour, President
Earth Community Organization
Dear Mr. DuFour:
Evolutionary panaltruism makes a cogent case for The Compassionate Global Society on a planetary scale ("concern for others and for those who
will succeed us . . . . . " - The Center for Naturalism), and for directed panspermia on a cosmic scale.
The cosmic propagation of life by intelligent life from infinity to infinity in the cause of reciprocity, oneness and perpetuity - in synergy with
cyclical phenomena including the birth and death of galaxies, stars and planetary systems - speaks to the deep human need (and that of all
intelligent life) to know from whence we came as well as to the equally important need for meaning and purpose.
Evolutionary panaltruism coalesces on a planetary and cosmic scale the mutual quest of all intelligent life for compassionate interconnectedness.

Cher Germain,
Perhaps you will be interested in a document titled: "Knowledge Policies
for Sustainable Development in Africa: A Strategic Framework for Good
Governance" (54 pages). The document claimed that African economies have
been involuntarily drawn into a knowledge race in which they may turn out
to be losers in the absence of adequate knowledge and governance
strategies. Not enough effort is being made to emphasize the centrality of
knowledge for sustainable development and to face the challenge of creating
innovative and competitive knowledge societies in Africa.
The document is attached. Grateful you share it with whoever could be
interested and for comments.
Kind regards and congratulations for your excellent work.

The two articles you have sent were stored in locations #1 and are also
listed in the Portal of the Global Community in location # 4. In this way,
our large membership and readers from all over the world will be able to
access of all your info. I believe transparency is an essential element
for the Global Connstitution dialogue.
It is a good thing Susan Curry told you about the work we are doing
as it relates to a Global Constitution. The Global Community has already
started this discussion, and you can find some of our ideas of our website.
I did not know you and your group were also interested. I do believe we
could join forces. For one thing who will be the Chair of the Global Dialogue?
The Global Constitution is certainly an important part of Global Dialogue
2006.
Global Dialogue 2006 is a project of the Global Community. It
is about:
Politics and Justice without borders
Theme
Actions for the good of all as per the Statement of Rights
and Responsibilities of the Global Community citizens.
You can see a Global Constitution transpires the theme. Your project
concerning the Global Constitution has been a project of the Global Community

the Global Community Parliament with its governing institutions and bodies

Being a part of our initiative does not mean you lose control of yours.
It means you expand your initiative to a large whole, the Global Community.
We are planning to come up with a first draft proposal by August
2005. We have already defined the Criteria for citizenship
(which also needs work). There are several other ideas on the Round Table
for discussion. We also have discussed the issues during previous
Global Dialogues. Our February Newsletter is almost completed and will
be published soon. It has a call for the creation of the Parliament's
Constitutional Affairs Committee. We ask our membership and the Global
Community at large to participate in either the Committee or as participant
to the Global Dialogue.
I agree to have a four-day conference focusing on the creation of a
Constitution for Earth and to have the first annual gathering would be
in Philadelphia, the birthplace of federalist government, where the U.S.
Constitution was signed on September 17, 1787. You mention focusing on
what Gandhi called the two essentials for the peace movement—"both depth
and breadth" is a great idea.

Hi Sue!
I have forwarded a message to you this morning (Monday here). It was
a copy of a reply letter to James T. Ranney with GLOBAL CONSTITUTION
FORUM, INC.
Him and his group are planning to organize a conference for the purpose
of developing a global constitution. Did you have a chance to read
the message I forwarded to you? We may be getting the short end of the
stick again as happened with the Earth Charter. Susan Curry, the
actual President of Earth Charter, is also a member of the Advisory Board
for their Global Constitution project. A few years ago, at the time when
the Global Community was developing the Charter of the Global Community,
Mirian Vilela, a member of Earfth Charter came forward to help. She
said their organization was working on developing the Earth Charter. I
accepted their help. It turns out that we were helping them more them helping
us. Our ideas were entrenched in the Earth Charter by skillfull writers.
Then, after Global Dialogue 2000 was over, they decided to drop us in a
bad way. No word about us was ever mentioned in their work of the
Earth Charter or publications.

Earth Government and its Global Constitution
Dear Kofi Annan, the United Nations Secretary-General,
We have sent many letters to your predecessors and to you starting November 1st, 2000.
I quote here a passage of that very first letter sent to you November 1st, 2000.
"Democracy is a political system based on the participation of the people. It foresees the
separation of powers among the judiciary, the legislative and the executive authorities, as well as
free and regular elections. I have learned to appreciate democracy. It is a great system, the only
system I would want to live in.
The United Nations organization is not a democracy. You more than anyone else know that the
organization badly needs an overall upgrading. You probably see a thousand ways to improve the
system but you cannot do it. Even if you could improve the system it would still not be a
democratically elected government. And most people on Earth would not feel that they belong to
an organization that cares. A sense of belonging is inexistent because people were not asked to
elect their representatives to govern Earth. They dont feel they have a voice, a friend or friends at
the United Nations. People feel cut out of what should have been a home.
One could discuss this state of affairs and perhaps you would want to participate in a Discussion
Roundtable on Earth Management - all Peoples together to be held August 2002. Your insights
would certainly be of a wonderful start to improvement.
During the World Congress on Managing and Measuring Sustainable Development - Global
Community Action 1, members of Earth Community (previously called The Global Community
organization) and myself have thought about many ways to make the world a better place to be
for all people on Earth. We believe that the one most important change that should be made is the
election of a democratically elected Earth Government. We have no doubt that Earth
Government would connect us all together, coordinate all efforts efficiently, and would give
everyone a fair chance to life. A vote is what counts! A vote would make me feel I belong! My
vote would make me feel that the United Nations have acknowledged my human rights. And if I
had happened to be born in a very poor country than my vote added to the millions others in the
same country would be powerful enough to bring changes for the better. I certainly hope so! Hope
is what this great movement for change is about. Hope is a great thing that can give a person a will
to make changes.
We call our organization Earth Community (previously called The Global Community) as we
managed to make contact with people from all countries in the world. Our members are from over
90 countries. Earth Community is in the process of forming Earth Government, a truly global
governing body based on universal values, global concepts and democracy. We have already
started to form the Interim Earth Government."
Today, I invite you to consider, in our nation Canada, making a simple move towards a global government, Earth Government; it has the potential
to initiate a movement towards a higher global ideal. This is a proposal to take this movement for a global democracy one step further
to consider our role in a society of nations as an individual nation striving for a true federacy of nations with very limited powers.
The Global Community is proposing here the formation of a federal global entity, the Earth Government, with very limited powers.
Earth Government should eventually be able to delegate the definition and application of its powers to the triple
structure of a basic democracy: Legislature, Judiciary and Executive.
The Global Community vision of Earth Government structure would include:
- Formation of a Legislature, the Global Parliament (House of Elected Representatives from member nations, Senate)
- Structuring of an Executive body, the Earth Council (Cabinet Ministers selected by Global Parliament Representatives, Departments)
- Integration of the global Judiciary, the Earth Court of Justice, into the Global Community Justice Network
This is a proposal that part of our sovereignty, our nation power, should be made available to be passed on to a sovereign body of a global nature,
this body being the Earth Government. Canada has the potential to be at the forefront of a global initiative to create the true
ideal of a global sovereign made of, and working for, all nations on the planet.
If Canada as a nation was to take such a stance, it would in fact establish our maturity amongst other nations. We would be taking a
step to ensure a greater global unity and hence a greater global freedom through the protection of nations and their populations' rights
by Earth Government. On reaching maturity, we as a nation should be willing to make a pledge to become a Global Community nation.
All of this is to achieve a greater order and freedom defined through global law.
This would be a step forward to forming a Global Community of nations, with a global sovereignty. The simple principle on which this
should work is that we as a nation are sovereign over our action unless we cause harm to another nation.
In essence, the only freedom a nation has to relinquish to Earth Government is its freedom to harm another nation. This of course
would require that a global constitution be defined for Earth Government.
It must define the extent to which that Earth Government may interfere with the affairs of individual nations under particular circumstances that
fit within the above bounds.
Taking this notion forward to the concept of forming a society of nations, it is clear that humanity has worked out a lot of the
principles behind the formation of social groups. To look at this from a global perspective there is a need to:
a) allow nations to truly express and maintain their individuality,
b) allow nations to work in a group arrangement to create a richer unity through acknowledged diversity,
c) deter any process of harm through the abuse of national power. This can come about when an individual nation or group of nations
suppresses another nation or group of nations,
d) deter any harm by the leaders of a nation to the population within that nation,
e) consider acknowledging international corporations as entities in the same realm as a nation and subject to
a similar justice,
f) change our way of life as per the Scale of Human and Earth Rights, the Charter of the Global Community, the Criteria
for becoming Global Community citizens, and
g) include the Global Constitution as one more level of Rule of Law on Earth.
At present there is no global body such as Earth Government. We have a global bureaucracy - the United Nations (U.N.). However this body
has no means of enforcing the rights of an individual nation. An individual nation would need to relinquish some small part of its autonomy to belong to a more central global body
defined by a global constitution that would uphold and protect its rights as an individual nation.
It may be thought that the U.N. is a governmental
structure – but in reality it does not have power. The position it
plays out is more of a bureaucratic nature. The UN was established
to bring unity to nations. This has been of great benefit to humanity.
However, in the current world situation, its structure and role are insufficient and inadequate. We are proposing here a replacement
global entity to the U.N.
Earth Government
The role of Earth Government should be to oversee member nations and act as the bestower of power to them.
In the event of there being a difference or conflict, Earth Government should step in to unify and
resolve issues. If at worst the situation does require the removal of power, it would have that ability.
What powers should Earth Government have over member nations?
Take Canada as an example. What powers has the Governor General of Canada over the provinces, over any Canadian institutions or even over
Canadians? Very little if any at all! The simple and clear power
that the Governor General has is made more obvious during election time. Post an
election a party taking office is given power to act initiated by the Governor General. On dissolving the 'parliament' for
re-election the Governor General has right to assign power to the body it sees fit to govern as an interim government prior to
election results. For most situations this is the operative process. However, another aspect of this power should be the ability to dissolve
a government if it is found to be in breach of the constitution or if there is an unworkable deadlock in the legislative government.
Those are the kind of limited powers Earth Government should have over member nations.
The office of the Governor General of Canada resembles better the powers of Earth Government more closely than does the US presidential
role. The president has power over the bureaucracy whereas the Governor General does not. In simple terms, apart from the standard
role of delegation of power to an incoming government and the return of that power prior to elections, the Governor General only has
power to dissolve a government if there is seen to be unresolvable conflict in the chambers.
If we were to take these national aspects of our Canadian governing bodies and parallel them on the global scale, the body that would
hold the global power would most probably be of global selection. The range of power would be limited to a range similar to our
Governor General's powers. It should have no right to interfere in the United Nation's policy making but it would have the power to
dissolve it if were found to be in breach of its constitution. Further, it could have the ability to dissolve the government of a
nation for re-election if it were found to be in breach of a global constitution defining the bounds of harmless action between
nations or within a nation.
Should the office of Earth Government be democratically elected or not?
An ideal presidential form of Earth Government should be objective and non-partisan. On electing any entity from within the nation
it would inherently create a subjective form not an objective one, the latter being what we are striving to do. A global body would be
less partisan than any individual or group within the nation itself. It is a necessity though, that the global constitution be defined
to support a non-partisan and objective treatment of any situation that may arise.
The nations that have the greatest power at present would find it hardest to
join Earth Government, as they would need to give over a part of that power. Hence it is best that less powerful nations such as ours, Canada,
go about instigating it, to provide the path for others to join.
We, as Canadians, have the opportunity to implement the new definition of Earth Government such
that Canada would move easily to this new global reality.
Not only would we be supporting a global societal structure but Canada would also simplify the decision process we would have to go through.
We are in a position to show ourselves as a nation with heart and one with higher ideals. Often Canadians have proposed and promoted
many higher ideals that have been implemented through the UN. We should continue in this role and provide initiative towards a higher
principle being practically implemented.
Historically, the origins of the political philosophy which defined the structure of our Canadian system were
brought about through the definition of the liberty of the individual within a society.
The rights of the individual were that the sole end for which mankind are warranted, individually or collectively, in interfering with
the liberty of action of any of their number, is self protection. The only purpose for which power can be rightfully exercised
over any member of a civilised community, against his will is to prevent harm to others. His own good, either physical or moral, is
not sufficient warrant. The only part of the conduct of any one, for which he is amenable to society, is that
which concerns others. Hence the use of the:
- Scale of Human and Earth Rights,
- Charter of the Global Community,
- Criteria for becoming Global Community citizens, and
- Statement of Rights and Responsibilities of Global Community citizens.
A point to be made here is that as a group of nations, at some point it is necessary for us to define a structure for this symbiotical relationship
of nations beyond its current undefined status. We need to view the relation of the
individual to the governing body. We can consider a symbiotical relationship as the microcosm. To
view the same relationship on a macrocosmic level, we could see a nation as an individual and Earth Government as a
governing body. Again, it is the symbiotical relationship between these two entities that is the key. The relationship between the national
body and a global entity should inherently have the same qualities as that of the relationship of a person to the
national body. The quality of the relationship is that of a symbiotical relationship.
The symbiotical relationship would be such that a member nation has
absolute right of independence except when that it is in breach of the rights of another and causes harm to them. At that point
only, does the Earth Government has right to exercise power to restrict the rights of the member nation.
In accepting this concept and that we have a group of nations, it would follow that at some point it is necessary to have a global
sovereign entity that only has right to exercise power over a nation, if that nation is in breach of another nation's rights. The
destruction of the global life-support systems is also included here as an action harmful to others.
A recommendation of the composition of Earth Council would be a small independent group appointed by Global Parliament.
The resolution of matters brought to Earth Council would be by consensus, the method used is similar to that of the Sociocratic Method of Decision
Making
As stated earlier, the role of Earth Government is to force a nation to
re-election if it is found to be in breach of the rights of another
nation or its own people. Earth Government should eventually be able
to delegate the definition and application of its power to the triple
structure of a basic democracy: Legislature, Judiciary and Executive.
Canada has an opportunity to be an example to other nations by:
1. expressing a willingness to relinquish a part of our national sovereignty to a global body,
2. encouraging the set up of the structure for Earth Government through the development of a global constitution and to allow and
encourage willing nations to become involved in such a structure, and
3. encouraging nations in a similar position to our own, who have recently gone through this process of separating from a monarchy or who
are considering it, to include provision for this body in their own national constitution.
Canada could do this by way of a National Referendum on the Global Constitution. Our own Canadian Constitution would have to be amended
during this process and eventually the new document ratified during a meeting of all federal, provincial and territory leaders.
Looking simply at the framework – the global constitution - to be set up for Earth Government, its purpose would be to:
1) define the threshold upon which Earth Government may in any way impinge on the sovereignty of a nation:
a) if it is seen to be truly harmful to its population,
b) if it is seen to be infringing on the rights or freedom of another nation (assault or the destruction of the global life-support systems),
2) define the simple bounds within which such Earth Government could act. A possibility presented above is that of being able to
dissolve a government for re-election only where that government is deemed to be in breach of the global constitution.
3) adopt global policies and strategies for proper Earth management. These would include many aspects shown here in the following table.

The United Nations is a potential body to be involved in the formation of Earth Government. Because of the short falls of the United
Nations in its current form we are putting forward several propositions for change within this body.
a) Independence of the representatives within the chambers of the United Nations. They must be independent of the governments of the
nations they are representing.
b) Structural changes to the body of the United Nations include the:
- Formation of a Legislature, the Global Parliament (House of Elected Representatives from member nations, Senate)
- Structuring of an Executive body, the Earth Council (Cabinet Ministers selected by Global Parliament Representatives, Departments)
- Integration of the global Judiciary, the Earth Court of Justice, into the Global Community Justice Network
Global Parliament, the Legislature
There is a need for a simple set of
laws to be defined that the judiciary do not have the power or scope to define. At some point a legislative assembly would need to be
defined under Earth Government to allow the courts to act on legislative rulings not just common law rulings.
The activity of Global Parliament is one of resolving problems by working out the definition of law.
This is reflected in the party structure - Government versus opposition, where one is proponent of a concept, the other opponent.
It is necessary to define within the global constitution the simple right of Earth Government to act to protect freedom of
nations. It is also necessary to create a global body whose role, empowered by Earth Government, would be to define the laws within
the domain in which Earth Government constitutionally has the power to act.
A key point to be made, considering our current dilemmas, is that there is a need to have independently elected people in the roles of the legislature. The representatives within the two assemblies of the UN today are directed by the governments of their nations and simply play the role of diplomats. Hence they conform to the agenda spelt out by their national government.
To take an analogy of this as represented in our own Canadian federal system, it would reflect as provincial governments directing ambassadors as
representatives in the national parliament. Would it be right to have representatives in the federal parliament defined by the provinces?
It would certainly not be. Federal matters need to be dealt with on a federal level (i.e. trade and immigration issues etc.). Similarly
global matters need to be dealt with independently on a global level.
In Canada all provinces are often in opposition to the federal government. That is part of our democratic process.
In going through the election process, different issues are addressed on a federal level than
those on provincial levels. Regardless of these differences the structure still works well and addresses the issues on the differing levels.
The simple implication of this is that there would be a need for an election process for positions in Global Parliament. They must involve
the proposal of policies by candidates. Global Parliament with no party structure is one end of the spectrum, a two party preferred
structure is another end, and there are many options in between. Having a Global Parliament with no party structure is a start, but evidence
on national levels with too many parties involved is that it creates difficulty in moving proposed legislation through.
If a party structure were to be considered then some bounds would need to be defined: that a party should not be based on separative
agendas involving religion, race, revenue or region. Ideally they should be based on principles such as progress, equality and freedom
to inspire the legislators to act on principles that reflect higher ideals. They should also be based on the protection of the global life-support
systems and the Scale of Human and Earth Rights.
- Scale of Human and Earth Rights,
- Charter of the Global Community,
- Criteria for becoming Global Community citizens, and
- Statement of Rights and Responsibilities of Global Community citizens.
Judicial System
It is the structure for the development of right social response. This is the mechanism for discerning right action relative to the law
defined by Global Parliament.
The judiciary is not there to define a breach, but it is there to
put to trial those who have been indicted as being in breach of laws
originating from the power of Earth Government. As stated above, this
power should eventually be further defined by Global Parliament,
accepted by Earth Government, implemented by the bureaucracy and
later referred to and refined by the Judiciary.
In order for the global judicial system to truly function, it must be recognised that it is structure to work on a global level. It is the
nation first that is accountable for its actions, the individual/s involved are secondary. Without the recognition of Earth Government,
the global Judiciary's purpose will not be so clear. The purpose of the global Judiciary should be to try the
nation (or global corporation) for an alleged crime. On a ruling against the nation, it must be made to release for trial the
individuals who instigated the harmful action. On release:
* the individuals involved should then be processed individually through the court, and
* power can then returned (via Earth Government) to the nation to enable a re-election/reformation of government.
Hence we see that the relation of Earth Government's delegation of rights is via the judiciary to carry out justice.
The governing body of the nation needs to be held accountable such that any breach can be tried. Only if it refuses to relinquish power
and be tried, can armed force be used to restrict the power of that governing body. Further, if a ruling is made against it and access
to the individuals involved is denied, similar force can be used.
Earth Council, the Executive
Earth Council is the active mechanism for the implementation of order defined by the law. It manifests the structures which implement the laws.
It is that which ideally evolves and progresses to meet the needs and circumstances surrounding it.
As stated above, the UN in essence does play the international role of the executive side of a government overseeing a bureaucracy.
It is striving to bring order via treaties. It would be wise to support the role it has played as a tool of the Executive.
This can be developed over time to reflect more truly the mechanisms used on national levels once the scope of the global sovereign
and key bodies are defined and put into place.
The UN does have two houses of representatives – the main chamber and the Security Council. However these representatives are the
diplomats of member nations whose interests lie on a different level to that which it is working. These diplomats are largely
expressing the ideals of those member nations on their own lower level. This does not encourage any unity on principles that are above the
workings of these individual nations.
Hence it could be suggested that, as a precursor to the implementation of a legislature, the bureaucratic side of the UN should be
clarified and defined as an independent body separate to these chambers and the form of the executive defined.
Looking at the executive side as the various departments that exist within the UN, another aspect to be considered for change is its
peace keeping force. Currently there is a provision for the UN to work with peace keeping forces from contributing nations. Nations
supplying armed personnel are reimbursed from contribution funding. The function of these forces is to act on a peace keeping agenda,
minimally armed.
This has only partially achieved the desired outcome. A change to this is necessary. The definition of Earth Government without any
provision for this would render it powerless. There must be some provision within the
global constitution for empowering an element of the executive body to take this role.
The Executive not only dispenses the honors, but holds the sword of the Global Community. The legislature not only commands the financing,
but prescribes the rules by which the duties and rights of every global citizen are to be regulated. The judiciary, on the contrary, has no
influence over either the sword or the financing; no direction either of the strength or of the wealth of the society; and can take no
active resolution whatever. It has judgments and must ultimately depend upon
the aid of the executive arm even for the efficacy of its judgments.
A proposal for this would be to define that a nation joining the Global Community
under Earth Government
must contribute armed forces when called
upon to provide them. This would not be considered as a gift or paid for by this body, but it would be mandatory. The nation must
provide the contributing force if called upon to support an action taken by Earth Government.
Further, management of the armed forces should inherently be carried out by a strategic group defined for Earth Government in the global
constitution, initiated and maintained by the executive. The size of the force a nation must contribute when called upon, should be
defined. An option could be to use a formula involving GDP in ratio to population.
Such a body with access to national forces would ensure Earth Government has some power to act. It would be hoped that this should
eventually become more of a global 'police force' of a similar nature to our federal police in Canada, the RCMP, rather than an army.
A key note to this is that the cost of arms to individual nations would inherently be reduced. In the long term it would be far less
expensive for a nation to provide a smaller force, which when combined with other nations would be equally or more powerful, than the
current excessive spending on arms by individual nations. Instead of spending billions of dollars on building a STAR WAR system of defense
and more weapons of mass destruction, it would be much cheaper and more efficace to form Earth Government and work through it for the security of all Peoples.
To give examples of the kind of action to be made by Earth Government
A) In the case of Serbia versus Croatia involving Slobadan Milosovich, the crime was not so much the individual actions
- massacres - as it was the war. It was the nation Serbia that was committing the crime of war, although individuals were eventually
held accountable for certain actions. In this case it was at a later date that the US used influence to get Serbia to indict the
criminals. Rather than an individual nation initiating this, it should have originated as a dissolution of the government
(an 'arrest'), by the power of Earth Government, enacted by Earth Council. Through trial and a ruling by the
Earth Court of Justice of the nation carrying out a crime, the nation would have been sentenced to relinquish that part of it that
was the initiator of the crime, the individuals responsible. On release of these, the nation would have been considered as having
been brought to justice. A new parliament would then be allowed to convene. When given over to the Earth Court of Justice, those
involved would be held accountable through the legal processes being set up at present.
B) In the case of Zimbabwe, we would need to connect the action of Mugabe directly to the slaughter of the
innocent. The case against that government should be simple – massacre
has occurred in the nation – hence the power of the governing body should be withdrawn through dissolution of the government and an
interim body put in place. This will allow investigation as to the source of the offending action and the key parties found to have
instigated it then are able to be brought before the international courts. Again as outlined above force should be available to enact
this if necessary.
C)
Indonesia in its current state would be well below the threshold of dissolution of government by the global body. Some of its
territorial policies have in the past, been deplorable, but by such a constitution they should not be interfered with because it has
changed government and at present it is not physically harming members of its population en masse or invading other territories.
However, in 1975 with the invasion of East Timor, the global body would have been well within its bounds to threaten dissolution of
the government if the Indonesian troops were not withdrawn. The government of the time would have been held accountable.
D)
In the case of Iraq a similar dissolution could have been carried out for its invasion of Kuwait as well as when clear evidence was
found of the Iraqi government having bombed the Kurds and harmed the population between the Tigris and the Euphrates. It is a nation's
harmful action, not its possession of arms that is operative.
E) Looking at Rwanda and Burma the perpetrators of the murder and oppression that have been occurring are not
easily identified from outside these countries. These examples show the need to indict the government for action that has
occurred rather than wait on longer processes needed to offer reasonable proof to allow the indictment of individuals.

a government if it is found to be in breach of the constitution or if there is an unworkable deadlock in the legislative government.

THE GLOBAL COMMUNITY
Dear people of THE GLOBAL COMMUNITY
My name is Jorge D. Rizo Blandon I’m a Nicaraguan, I was born and live in Nicaragua, Central America. The reason why I’m sending you this
letter today is to let you know first who I am and second what’s the objective of contacting you. As you know my country is one of
those nations known as the Third World Countries or Developing Countries. I’m one of those persons who want to see Nicaragua as a
productive and developed country and look for or at least cooperate in a solution of the extreme poverty and hanger that many people
is living in, mainly in rural areas of Nicaragua. I also think that decision from politic representatives in this country won’t help
in anything to improve the future of those people in rural areas.
Due to my family’s background, I started to work in agriculture since I was a little kid helping my dad in all kind of agricultural
tasks. My dad has always been a farmer; therefore, agriculture has always been part of my life and I always wanted to study an
agricultural major at university. After I acquired my high school diploma with honors as the second best average grade in that school
I was called from the United States Agency for the International Development (USAID) mission for Nicaragua, to compete for a scholarship
sponsored by that agency, administrated by Georgetown University in Washington U.S. and coordinated by the Cooperative Association of
States for Scholarships (CASS) to study a major in agricultural business. Four months ago, I finished and I came back to Nicaragua from
a two year-term program of studying at a Junior College in the San Joaquin Valley in California as a part of that prestigious program
from which I was granted. Currently I’m studying at a local university in order to finish my major and get my bachelor degree. My
experience as a CASS student helped me to enhance my professional career and my willingness to continuing working hard for my
community’s development as well as my country.
Now that I had the opportunity of going to study to the United States an Agribusiness major I want to take advantage of that experience
and make that experience real down here in Nicaragua. In fact I do not want to waste that opportunity that agency gave to me, so that
I can do something productive for my community since they spent a lot of money giving me this scholarship. My main goal now is
founding a nonprofit organization in my community where I can work together in partnership with small and medium farmers, no matter
what gender the associates are. So that they can get a just benefit from their production; all with the support of our programs or
projects; not only in farming assistance or natural and environmental conservation, but also in areas like medicine, education,
rural-social development, and if possible shelter, food distribution and clothing. For now I would like to start with a couple of
projects with the support of any non-governmental organization. I’ve been working in projects that that I’m planning to perform;
however, I can do nothing if I don’t let anybody know about what I’m doing and what I want to do in favor of my community.
That‘s why I decided to search everywhere for charity foundations, non-governmental organizations or even investors that are
able to support projects in developing countries in such areas as education, farming assistance and the others previously
mentioned.
Consequently, I considered contacting you, as the director of that organization taking in account that you might
be interested in promoting and supporting a good project for these forgotten small communities. I’m determined and able to
seriously accept any proposal from your organization so that we can initially set a fraternity and reach any type of agreement.
I really want to thank for the time you’ve taken to read this letter, I hope you get strongly interested in support this idea
and I hope from you an optimistic answer, as I mention before I’m not interested in making profit. On the contrary, I just want to do this in the only benefit of poor people in rural areas formulating projects and working together to improve their life
quality and enhance globally in a way my community’s economy. I consider my best strength the willingness I have for doing something
for my community and a high leadership sense to coordinate people and make them more productive, I think that somebody has to
something for this communities and for this people.
Please feel free to get in contact with me at: www.jorgemjc@yahoo.com
Thank you very much:
Respectfully:
